These Terms of Service ("Terms") govern your use of our website, https://hellomakenby.com, your submission of a Free Google Audit request, and your purchase or use of our services.
By using our website or requesting services, you agree to the provisions of these Terms applicable to that activity. Additional terms for paid services will be provided before purchase.
Hello Makenby provides digital marketing and business growth services primarily for local businesses, including HVAC companies and other service-based businesses.
Services may include:
Google Business Profile optimization and management
Local search visibility monitoring and reporting
Customer review management and reputation support
Google Business Profile content and posting
Website-related services
Marketing automation and lead management
AI-powered business communication solutions
Other agreed-upon digital marketing services
Specific services, deliverables, pricing, and payment terms will be outlined in a separate service agreement, proposal, checkout disclosure, or written confirmation when applicable.
Not every service listed above is included in every package.
Hello Makenby may provide a complimentary audit of a business's online visibility and Google Business Profile.
By requesting an audit, you authorize us to review publicly available business information, including Google Business Profile details, online reviews, website information, and local search visibility.
The audit is informational and may identify opportunities for improvement.
A Free Google Audit does not guarantee specific Google rankings, additional customers, increased website traffic, or business revenue.
Requesting an audit does not obligate you to purchase paid services.
Hello Makenby's introductory Google Visibility & Reputation Management Plan is offered at $397 per month, unless a different price is disclosed and agreed upon before purchase.
The standard plan covers one eligible business location and includes the specific services described in the applicable order or service agreement.
Additional business locations, specialized projects, optional add-ons, and services outside the agreed scope may require separate fees.
Hello Makenby will disclose the applicable charges before providing paid additional services.
Monthly subscriptions are billed in advance and automatically renew each month until canceled.
Before enrollment, clients will be informed of the recurring price, billing frequency, cancellation method, and any applicable fees.
By enrolling in a recurring subscription and authorizing payment, the client agrees to the disclosed recurring charges.
Payments may be processed through authorized third-party payment providers.
Any applicable taxes or additional charges will be disclosed as required by law.
Hello Makenby's standard monthly plan does not require a mandatory long-term contract.
Clients may cancel their monthly subscription at any time by following the cancellation instructions provided at enrollment or contacting Hello Makenby through its designated support channel.
To avoid the next monthly charge, cancellation must be completed before the next scheduled renewal.
Unless otherwise agreed in writing or required by law, cancellation takes effect at the end of the current paid billing period.
Cancellation does not automatically entitle a client to a refund for services already performed or the current billing period.
We recommend allowing approximately 90 days to evaluate progress from ongoing local visibility services. This recommendation does not create a minimum contract term or limit the client's cancellation rights.
Fees for completed setup work and services already performed are generally nonrefundable, except where required by applicable law or otherwise agreed in writing.
Any refund request will be evaluated according to the services delivered, the applicable agreement, and relevant legal requirements.
Nothing in these Terms limits statutory refund rights.
Clients must have the legal authority to request management services for the business accounts they provide.
Clients authorize Hello Makenby and its approved service providers to access and manage designated accounts only to the extent necessary to perform agreed services.
Clients retain ownership and control of their Google Business Profiles and other business accounts.
Hello Makenby will not claim ownership of a client's Google Business Profile.
When services end, Hello Makenby will reasonably cooperate in removing its management access and facilitating the client's continued control of its business accounts.
Clients are responsible for providing accurate business information and appropriate access permissions.
Hello Makenby may use third-party software, automation platforms, contractors, and service providers to perform agreed services.
These providers may support Google Business Profile optimization, review management, reporting, content creation, marketing automation, and related business functions.
Hello Makenby remains responsible to its clients for the services it agrees to provide, subject to the applicable service agreement and law.
Where necessary, authorized service providers may receive access to relevant business information and systems for service delivery.
Use of third-party technology is subject to applicable privacy, security, and platform requirements.
Hello Makenby may change service providers or technology platforms provided that agreed service obligations and applicable data protection requirements continue to be met.
Hello Makenby is an independent marketing services provider and is not affiliated with, sponsored by, or endorsed by Google.
Google Business Profile is a free Google product. Fees charged by Hello Makenby are for professional management, optimization, monitoring, reporting, and other agreed services.
Google and other third-party platforms control their own policies, algorithms, features, and account eligibility requirements.
Hello Makenby cannot guarantee that third-party platforms will approve every change, maintain every feature, or display a business in a particular position.
Clients must comply with applicable third-party platform terms and policies.
Hello Makenby's reputation management services are intended to encourage authentic customer feedback and support professional business responses.
We do not guarantee a particular number of positive reviews or a specific star rating.
Hello Makenby does not knowingly create fabricated reviews, purchase misleading reviews, or engage in prohibited review manipulation.
Clients are responsible for ensuring that review requests and responses accurately represent their businesses and comply with applicable laws and platform policies.
Automated or AI-assisted review responses may require review, correction, or approval.
Certain services may incorporate artificial intelligence or automated systems to support business profile updates, content creation, customer communications, reporting, or related activities.
Automated outputs may occasionally contain errors or inaccuracies.
Hello Makenby may review, modify, or reject automated content where appropriate, but does not guarantee that all automated outputs will be error-free.
Clients must provide accurate business information and promptly notify us of incorrect content or changes affecting their operations.
Where services involve calls, texts, or other automated communications, the parties must comply with applicable consent, disclosure, and communication laws.
Clients agree to:
Provide accurate and current business information.
Maintain appropriate ownership and access to business accounts.
Cooperate with reasonable onboarding and verification requests.
Notify Hello Makenby of material changes to business hours, services, locations, and contact information.
Review business-specific content and claims when approval is requested.
Use services in compliance with applicable laws and third-party policies.
Delays caused by missing information, unavailable account access, or required client approvals may affect service timelines.
Hello Makenby aims to improve the quality, consistency, and management of clients' online business presence.
However, no specific search ranking, Google Maps placement, customer review volume, lead count, sales volume, or revenue increase is guaranteed.
Results may be influenced by competition, customer behavior, market conditions, search algorithms, business history, and factors outside our control.
Any projections, examples, case studies, or estimates are illustrative and do not guarantee future performance.
Hello Makenby retains ownership of its proprietary branding, processes, website materials, templates, and other intellectual property unless otherwise agreed.
Clients retain ownership of materials and information they lawfully provide.
Ownership, licensing, and transfer of any websites, creative materials, or other deliverables developed for clients will be determined by the applicable written service agreement.
Clients grant Hello Makenby and authorized service providers the limited permissions reasonably necessary to use supplied materials for agreed service delivery.
Hello Makenby will handle personal information in accordance with its Privacy Policy and applicable law.
We may share information with authorized technology and service providers where reasonably necessary to deliver purchased services, subject to appropriate legal and contractual safeguards.
Both parties agree to use reasonable care when handling confidential business information received during their relationship.
Additional data protection or confidentiality agreements may apply where required.
Visitors and clients may not use our website or services to engage in unlawful, fraudulent, deceptive, or unauthorized activities.
Prohibited activities include attempting unauthorized system access, interfering with website security, distributing malicious code, and infringing the rights of others.
We may restrict access when reasonably necessary to protect our systems, users, or legal interests.
Hello Makenby may improve, update, or replace software and operational processes used to deliver its services.
Service availability may be affected by third-party platforms, outages, account restrictions, or circumstances outside our reasonable control.
Material changes to an active client's agreed service scope or price will be communicated and handled in accordance with the applicable agreement and law.
To the extent permitted by law, our website and complimentary informational materials are provided on an "as available" basis.
We do not warrant uninterrupted website availability or error-free performance.
Any specific warranties or commitments for purchased services will be governed by the applicable written agreement.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Hello Makenby and Makenby Media LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services, including lost profits or lost business opportunities.
Any limitation on direct liability relating to purchased services will be governed by the applicable written service agreement.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
Hello Makenby may suspend or terminate services for material nonpayment, misuse, unlawful conduct, or substantial violations of an applicable agreement, subject to required notice and applicable law.
Clients may terminate monthly subscriptions according to the cancellation policy.
Upon termination, the parties will reasonably cooperate regarding access removal, outstanding payment obligations, and any required transfer or retention of client information.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, except where applicable law requires otherwise.
Any specific dispute resolution or venue provisions for paid services will be addressed in the applicable written service agreement.
Hello Makenby may update these Terms from time to time.
The current version will be made available on our website with its effective date.
Material changes affecting existing paid services will be handled in accordance with applicable agreements and law.
